By creating an account or using Pacely (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms form a binding legal agreement between you and Pacely ("we," "us," or "our"). We may update these Terms from time to time — we'll notify you of material changes by email.
Important: Pacely is a training coaching tool, not a medical service. Pacer is an AI coach — not a licensed physician, physical therapist, or healthcare provider. Nothing in the Service constitutes medical advice, diagnosis, or treatment.
Before beginning any new exercise program, especially if you have a medical condition, injury, or health concern, consult a qualified healthcare professional. If you experience pain, dizziness, shortness of breath, or any unusual symptoms during exercise, stop immediately and seek medical attention.
By using Pacely, you acknowledge that you exercise at your own risk and that we are not liable for any injury or health outcome resulting from training recommendations provided by the Service.
You must be at least 13 years old to use Pacely. By creating an account, you represent that you meet this requirement.

You may only create one account per person. Accounts created by bots or automated methods are prohibited.
Pacely offers a free tier and a Pro subscription ("Pacely Pro"). Pro is available monthly ($9.99/month) or annually ($79.99/year).

Price changes
We'll give you at least 30 days' notice before changing your subscription price. If you don't cancel before the price change takes effect, you agree to the new price.
Refunds
Subscription fees are generally non-refundable. If you believe you were charged in error, contact us within 14 days of the charge at support@pacely.coach and we'll review your case.
New users may be eligible for a 7-day free trial of Pacely Pro. During the trial:
Free trials are limited to one per person. We reserve the right to modify or discontinue the free trial offer at any time.

We reserve the right to suspend or terminate accounts that violate these rules.
Pacely and all associated content — including Pacer's name, the app design, training plan formats, and coaching methodologies — are owned by Pacely and protected by intellectual property law.
We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use. This license does not include the right to copy, modify, distribute, sell, or lease any part of the Service.
You retain ownership of the data you provide — your training preferences, health data, and conversations with Pacer. By using the Service, you grant us a limited license to process this data to deliver your coaching experience, as described in our Privacy Policy.
We do not claim ownership of your health data or use it to build products beyond Pacely.
By you: You may delete your account at any time from profile settings. Upon deletion, your data is removed within 30 days, except data we're required to retain by law.
By us: We may suspend or terminate your account if you violate these Terms, or if we discontinue the Service. We'll give reasonable notice where possible. If we terminate for reasons other than your breach, we'll refund any prepaid subscription fees on a prorated basis.
The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that:
To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Pacely shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including injury, loss of data, loss of profits, or loss of goodwill — arising from your use of the Service.
Our total liability to you for any claim arising from your use of the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow certain liability limitations. In those cases, our liability is limited to the maximum extent permitted by law.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Before filing any legal claim, you agree to contact us first at support@pacely.coach and give us 30 days to resolve the issue informally.
If a dispute cannot be resolved informally, you and Pacely agree to resolve it through binding individual arbitration, not class action. The arbitration will be conducted under the rules of the American Arbitration Association (AAA).
Class action waiver: You may only bring claims against Pacely in an individual capacity, not as a plaintiff or class member in any class or representative proceeding.
We may update these Terms as the Service evolves. When we make material changes, we'll notify you by email and update the "Last updated" date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
